Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Strategia-X (“Company,” “we,” “us,” or “our”) governing your access to and use of the Dynasty-X website (dynasty-x.com), the Strategia-X platform (strategia-x.com), all associated Android applications, and any related services, features, or content (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 13 years of age (or 16 in the European Economic Area and United Kingdom) to use our Services. By using our Services, you represent and warrant that you meet these age requirements.

If you are under the age of 18 (or the age of legal majority in your jurisdiction), you may only use our Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

Strategia-X develops and publishes Android applications and web-based tools under the Dynasty-X brand, including but not limited to:

• Sys-Monitor: System diagnostics and monitoring application
• DeviceLab Monitor: Device health and performance monitoring
• DeviceLab Offroad: Off-road trail and vehicle diagnostics
• DeviceLab Audiophile: Audio analysis and measurement tools
• DeviceLab NetTools: Network diagnostics and analysis platform
• DeviceLab Tradesman: Professional trade tools and measurements
• DeviceLab DJ Pro: Professional DJ mixing and performance

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Some of our Services may require or offer the option to create a user account. If you create an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete, or if you violate these Terms.

You agree not to use our Services to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon or violate the intellectual property rights or privacy rights of others
• Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to any portion of the Services, other accounts, computer systems, or networks connected to the Services
• Use any automated system, including bots, crawlers, or scrapers, to access the Services without our express written permission
• Interfere with or disrupt the integrity or performance of the Services or the data contained therein
• Attempt to decompile, reverse engineer, disassemble, or hack any of our applications, except as permitted by applicable law
• Use the Services for any unauthorized commercial purpose or to compete with Strategia-X
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Use network scanning or diagnostic tools provided by our applications for unauthorized penetration testing, network attacks, or any malicious purpose

6.1 Our Intellectual Property

The Services and all content, features, and functionality thereof — including but not limited to all information, software, source code, text, displays, images, video, audio, design, presentation, trademarks, logos, and the arrangement thereof — are owned by Strategia-X, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The names “Strategia-X,” “Dynasty-X,” “STX-1,” “Sys-Monitor,” “DeviceLab,” and all related logos and product names are trademarks of Strategia-X. You may not use these marks without our prior written permission.

6.2 License to Use Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial purposes. This license does not include the right to:

• Modify, copy, or create derivative works based on the Services
• Distribute, publicly display, or publicly perform any content from the Services
• Use data mining, robots, or similar data gathering and extraction methods
• Download (other than page caching) any portion of the Services except as expressly permitted

6.3 User Content

You retain ownership of any content you create, upload, or share through our Services (e.g., feedback, bug reports, feature requests). By submitting content to us, you grant Strategia-X a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and improving our Services.

7.1 Pricing and Payment

Some of our Services may be available for purchase or subscription through the Google Play Store or other authorized platforms. All purchases are subject to the applicable platform’s terms and conditions.

Prices for our Services are subject to change without notice. We are not responsible for any charges or fees imposed by your mobile carrier, internet service provider, or the platform through which you access our Services.

7.2 Refund Policy

Refunds for purchases made through the Google Play Store are governed by Google’s refund policy. For purchases made directly through our websites, we offer a 30-day refund policy from the date of purchase if you are unsatisfied with the product.

7.3 Subscriptions

If you purchase a subscription, it will automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage and cancel subscriptions through your Google Play Store account settings or by contacting us.

Our Services may contain links to third-party websites, services, or applications that are not owned or controlled by Strategia-X. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

Your use of third-party services is at your own risk and subject to the terms and conditions of those services. We strongly recommend reviewing the terms and privacy policies of any third-party service before using it.

Specifically:

• Diagnostic Data: System readings, network scans, and sensor measurements provided by our applications are for informational purposes only and should not be relied upon as the sole basis for critical decisions
• Network Tools: Network diagnostic results are provided as-is and may vary based on device capabilities, network conditions, and environmental factors
• Audio Measurements: Audio analysis results are dependent on device hardware and are not substitutes for professional calibration equipment
• Trade Tools: Measurement tools are intended as aids and should not replace certified measurement instruments where precision is legally or professionally required
• AI Features: AI-generated content, including stem separation results, is produced by machine learning models and may contain inaccuracies

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

You agree to defend, indemnify, and hold harmless Strategia-X, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Services
• Your violation of any rights of a third party
• Your violation of any applicable law or regulation
• Any content you submit or transmit through the Services

12.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The arbitration shall be conducted in the English language. The arbitrator’s decision shall be final and binding.

12.3 Class Action Waiver

YOU AND STRATEGIA-X AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Additionally, residents of the EEA/UK retain the right to bring claims in their local courts.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

If you are a resident of the European Economic Area, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer under applicable local law.

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the Services will immediately cease
• All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability
• Data stored locally on your device will remain accessible until you uninstall the application

You may terminate your use of the Services at any time by uninstalling our applications and ceasing to access our websites.

Our applications may include open source software components that are subject to their own license terms. Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms of any applicable open source license. Open source license notices are available within each application’s settings or about section.

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and sanctions programs administered by the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC). You represent that you are not located in, or a resident or national of, any country subject to U.S. government embargo.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Strategia-X.

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Strategia-X regarding the use of our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Last updated” date at the top of this page
• Provide notice through our Services, website, or via email
• Allow a reasonable period for review before changes take effect

Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Services.
